(Befora His Honor Mr Justice Cooper.) CT.AIM FOR DAMAGES, i The hearing of argument m the cast of Mabel and Eliwibtth Field (Mr Bur nard) v. Alexander Thomson (Mr W. L. Rees) was continued this alternoon. His Honor, m the course of his sum ming up, stud the child was not undei any obligation to undergo treatment fo; the removal of the scar, which was < disfigurement that may remain on hei for all time, or whicn, as the doctor, fold, said, might possibly disappear witl an improvement m health. These wen elements for the consideration of th( jury, if they were of opinion plaintiff, should succeed, m assessing reasonable damages as a solatium to the child anc her mother. His Honor did not con sider there- wus any appreciable evidenc. to apprehend damage to the child's con stitution. , ' '„ '
The jury, of -which Mr Kimpton wa,foreman, retired at 3.30 p.m. After 25 minutes' retirement; the jun returned with a verdict for plaintiff fo; £60, plus medical expensas, £9 7s.
