The matter of Willoughby Brassey, solicitor, was brought before Chief Justice Prundergast in the Supreme Court this morning. On Monday in. an application to have him struck ofl' the roll a rule nisi was granted, and counsel now applied to have the rule made absolute. Ml 1 Cornford appeared for the Law Society and Mi 1 Cresswell for Brassey. Mr Cornford said the general case was this : J. P. Hamlin, as trustee, employed Brassey to recover some rent, and instead of paying the money over Brassey used it for his own benefit. Hamlin sued for it, but unsuccessfully, as Brassey became a bankrupt, but the latter alleged he was authorised by Hamlin to retain the money as a loan. In answer to this Mr Lascelles, solicitor, filed an auHdavit giving an absolute contradiction to the statement and that on no occasion did Brasscy ever raise such a ground for such consideration. Brassey's affidavit in reply was that he had permission to use the money. The. Chief Justice said if a person was allowed to use money as his own the inability to pay in time was not dishonesty. The matter was allowed to stand over til! this afternoon to enable Mr Cornford to tile another affidavit from H. Hamlin in reply to a particular allegation by Brassey.
