Cooper's rule nisi has been abandoned, the judgment being one month's imprisonment with hard labor in default of payment of fine and coats.
The Supreme Court was occupied all yesterday, with the case of Sutton against Todd, an action for £1,000 damages for alleged unskilful and negligent medical treatment. Plaintiff is a butcher at Te Auto, and in May, 18S0, was thrown from his cart when returning home from Waipawa. Defendant was sent for from Waipawr and attended plaintiff. On examining him, Todd said nothing was broken or out of place, but there was an internal bruise on the right arm, which would take some time to heal. Plaintiff's right arm continuing useless, he came to Napier, and was examined under chloroform by Dra. Spencer and Menzie, who discovered that the right shoulder was dislocated, and though they made strong efforts to reset it, they could not. In their evidence they stated they considered the injury permanent. Tho jury gave a verdict for plaintiff for £150. Notice of application for a new trial wag given by defendant's counsel.
