RESIDENT MAGISTRATE'S COURT.
(Before Captain Gudgeon, R.M.) This Dat. _The case for the prosecution against Henry Evans for larceny of the property of Messrs. Kinross and Graham, con* eluded at 1 o'clock to-day. The case has now been before the Court for three days, and as many as sixteen witnesses have been examined. At the conclusion of the examination of the witnesses, Mr. W. Brassey addressed the Court m defence of the accused, and made a lengthy speech, stating that there was not the least evidence to prove the charge preferred against . him. No distinct evidence that any demand m writing for the money according to the bill of sale was made. The bailiff was not m charge when goods were removed. The Bench was of opinion that there was not the least doubt that an offence had been made (out. The evidence was incoherent and shaky, but he would under the circumstances commit' accused for trial at the next sitting of the District Court Gisborne. ; Bail of £100 and two sureties was allowed. A second charge of larceny as a bailee was preferred against him. Mr. Rogan. said that the prosecution had no evidence to adduce. The Bench dismissed the charge.
