THE BRITISH NOTE.

HANDED TO JARJIN, APOLOGY, PUNISHMENT AND ASS UR ANCE DEMANDED. (Received 11.40 a.m.) United Press Assn.—By Electric - Telegraph—Copyright. LONDON. August 29. The Official British Not© to Jepan requests formal apology for the Hugessen incident, suitable punishment for the culprits and an assurance against a recurrence of a similar incident. The Note after recounting th© facts of the shooting states that the British Government received with deep distress and concern the news of this deplorable event in, respect of which it must record an emphatic protest and ,a. request for lull redress. It adds that the facts make it clear that it Was not an accident resulting from normal hostile operation and ■it should ha ve been obvious to aircraft that they were dealing with non-combatants. The plea if it. is made that the flags carried were over-small to be visible is irrelevant and the attack n*i justifiable even if. the car carried no flags at all. The real issue is that the occupants of the oar were non-com hat ants and the aircraft which doubtless did not intend to attack the Ambassador as such, though apparently they did intend to attack non-combatants which, in itself is illegal. The fact that, no actual state of war has been declared or been expressly recognised by either party to exist emphasises the inexcusable nature of the occurrence.

Mr Dodds, has handed the British Note to M. Ilirota who said that the Hugt'ssen incident was under joint An-glo-Japanese investigation and a Shanghai communique will be issued when t*h«© facts are clear.
