An allegation that he induced people to advance money to the Investment Executive Trust Company of New Zealand by means oi a ialse prospectus* which lie had issued in New Zealand in 1933 was made against John AYilliam Shaw AlcArthur in the Police Court today. It is alleged that the prospectus had stated that the Investment Executive Trust adopted a policy of diversification or of spreading the capital over a large number ot &ouud This statement had concealed the true nature oi the company’s investments, and AfcArthur, knowing the prospectus Jto lie false, had indicated his intent thereby to induce i>ersons to advance money to the Investment Ex**cutivo Trust.

Air R. AYindeyer, K.C., lor AlcArthur, said it might be necessary to ask lor an adjoin ninent for the purpose of obtaining certain documents from New Zealand. **A\ e have written to the Attorney—General and the Public Trustee in New Zealand a n< t have asked for access to these documents,” he said, ‘*but we do not know yet what the answer is.” Detective Robinson, of New Zealand, said he was instructed recently to arrest AlcArthur, and a warrant was Liken out immediately. He had executed this warrant to-day. Long argument followed as to the Alagistrate's power to sign a warrant.

AAindeyer contended that the prosecution was vindictive.

The Alagistrate finally admitted a warrant and Detective Robinson asked that AlcArthur be handed to his custody for trial in New Zealand.

Air AA’indeyer again objected, contending that the papers should be exannned in order to test the bona tides or otheiwise of the prosecution. The Alagistrate said that, as no reply had been received from New Zealand to the letter asking for the documents, he would adjourn the case until Tuesday. He added that it was for the defence and not the Crown to establish the bona of the prosecution.

Bail was allowed in the sum of £250.
