A,n i n teres ting legal point was raised in civil case 'heard in the Carterton Magistrate's Court yesterday, in which Feist and Co., Ltd., general merchants, sued S. Swan, of Carterton, for .-£2B 2s 2d, balance alleged owing for goods supplied. At the conclusion of plaintiff’s case counsel for the defendant applied for a 11011-suit on the ground that plaintiff failed to prove the incorporation of the company. In summing up, tlio magistrate, Mr J. Miller, S*.M.. said •b* had no alternative, but to uphold the technical! legal point raised, but no costs were allowed.
