Pahiatua S.M. Court.

Tuesday, November 29, 1894.

[B«(or* Uwn Reoe and Hughes, J’sP.] TBirr. William Higgins was charged with having stolen one tin of kerosene, the nrenert; of David Coskhura, storekeeper, Maknri. Constable Cooper applied for a remand for seven days, as the accused was only arrested yesterday. The remand was granted. Mr A. W. Gould, who appeared for the accused, applied for bail, which was grant jd in two sureties of A'2s, and the accused in the sum of £#>. ASSAULT.

William Vile v. Marion Knight.—This was a charge of derfent cut having assaulted a bailiff while in the execution of his duty. Mr Smith appeared for the accused and applied for an adjournment for a week, as his client was 100 indisposed to attend. Mr A. AY. Gould appeared (ortha plaintiff and objected, as there was no medical certificate produced. The Bench decided to hear the case against Herbert U. Knight who was charged with having assaulted a bailiff while in the execution of his duty. Accused was also charged with having attempted to rescue goods that had been levied so by the Court. Mr A. W. Gould appeared to protecutt •m behalf of tho bailiff, and Mr G. H, Smith dofoadod. W. Vilo oaid ho was acting as bailiff. On tho oeeasion in question ho had a wai rant to seize a trap aad horse. The trap and horse wore in Pahiatua and ho served the warrant on aceused and attempted to take the articles in question but the acouaed obstructed him. At this point Mr Smith applied for a re* mand as he was not aware that warrants had been served, ami he would require tho attendance of Mrs Knight. He called Mr Knight who said his wife was ill and was not likely to be up that day. Mr Gould applied for his witnesses' ex* penses as he had four in attendance and was prepared to go on with the case. The Bench granted a remand for a week with costs amounting to j£l 7s 9d.
