NOTICE OF ACCIDENTS
OBLIGATION ON INSURED PERSONS.
WELLINGTON, August 26. The necessity for an insured person promptly notifying an insurance company of the fact of any accident was stressed by-the Chief Justice (Mr Justice Myers) and counsel in the Supreme Court to-day in relation to motor insurance third party risks. The A.P.A. Union Assurance Company claimed £478 12s from Leslie Albert Harman, a taxi proprietor, this amount being awarded to one Flitcroft against Harman as the result of a collision with one of the defendant’s cars.
. “ Here,” said his Honor, “ the defendant calmly ignored the obligation imposed upon him by statute. The accident happened on March 19, and the insurance company docs not become aware of it until October 10, and even then not because of any information given by the owner of the car. It is quite obvious the position of the company in the meantime may have been prejudiced.” Judgment was given for the full amount.
