USELESS LITIGATION.

WELLINGTON, October 7.

Several times William Edward Timmings~lias ventilated a grievance in the courts in respect of a transaction which took place over 22 years ago. Each time he has been ruled against. At the beginning of this month he started fresh proceedings in the Supreme Court, claiming relief from George Treadgold in connection with a transaction, but again he has been unsuccessful.

In his reserved decision Mr Justice Ostler said, that Timmings had no cause of action against the defendant and entered judgment for the defendant. “ I trust,” said his Honor, “ that the plaintiff, who is a hard-working man and a useful citizen, will now be able to get this trouble out of his mind and throw no more money away uselessly in litigation in which he cannot hope to succeed.” His Honor added that in justice to Mr R. H. Boys, who appeared as counsel for the plaintiff, he thought he should mention the fact that counsel not only did not advise the bringing of the action but clearly advised the plaintiff that the action could not possibly succeed and that to bring such an action was a waste of monev.
