CHRISTCHURCH, June 27. An application under the Family Protection Act was heard before Mr Justice Adams at the Supreme Court to-day, when Brian Llansenw-yr Lewis, of Dann’evirke, farmer, asked that a sum of £4OOO be set aside out of the estate of Charles Lewis, late of Waipukurau, farmer, deceased. Mr Wilding, for the applicant, stated that his client, who had seen considerable war service, had had the misfortune to lost £5OOO, representing a grant from nis father, in a farming venture. The failure occurred during the slump following the boom period. Differences then arose between the 'applicant and his father which had not been healed at the date of the testator’s death. All the beneficiaries were desirous that some suitable provision should be made for the applicant, who had no beneficial interest under the will. The net value of the testator’s estate was estimated at approximately £14,000. Mr Donnelly, who acted on behalf of the other beneficiaries, supported the application, adding that the testator recognised that he was somewhat in the wrong with reference to the differences between himself and applicant. Unfortunately, the testator became ill and died before any alteration of the will could be made in favour of the applicant. His clients were quite agreed that the applicant should be granted the interest of £4OOO. An order was granted for th e £4OOO on the terms agreed between the parties, subject to certain conditions.
