AN ERRONEOUS REPORT.

TRUSTEE’S INTENTION MISCONSTRUED. . AUCKLAND, September 9. In connection with the judgment of the Supreme Court, in the case arising out ff the will of the late Mr John Herbertson, one of the plaintiffs, Mr Edmust M‘Nair, desires it to be l ated that it is tiis intention to hand his commission as trustee to the Mayoress's War Memorial Library Committee as desired by the testator. In the report of the judgment in error occurred in a vital sentence which might have led to the impression that there was some doubt as to Mr M‘Nair’s attitude. This is not so. He was a »-laintiff in the case and urged that the wish of the testator should be given effect to in its entirety. Apart from small bequests the institutions to benefit by the late Mr Herbertson’s will are Knox Home, the Leslie Presbyterian Orphanage, the Greymouth Borough Council and the Jedburgh Parish Council in Scotland.
