TE KTJiTI, July 24. The Waitomo County Council is suing Thomas Borthwick and Sons for £l9O extraordinary damage to the Te Kuiti-New Plymouth road, alleged to have been caused by cattle driven to defendants'" works at Waitara. One of the main points in plaintiff’s case was that the extraordinary damage had been caused during the last two and a-half seasons, and that defendants had been operating on a large scale since the beginning of that time. The defence called evidence to show that the damage was not as exclusive as plaintiffs claimed; that defendants had been operating on a large scale since 1920, that Borthwick’s business was necessary to the welfare of the settlers, and that the cattle driven by them was less in proportion ftoi settlers’ cattle than the plaintiffs. Decision was reserved.
