£BSO AWARDED. BOTH SIDES MOVE FOR JUDGMENT. WELLINGTON, June 25. A. sequel to the case in which Guy Leslie Fulton was charged with manslaughter arising out of the death of a man named Huskisson, and in which the jury several times disagreed, has been occupying the attention of Mr Justice Sim and a special jury for some davs. Ethel Rebecca Iluskisson, deceased s wire, claimed £3OOO damages from Fulton. Huskisson was a passenger in a gig driven by James Richard Croft on October 2, 1920, and with this conveyance a motor car driven by Fulton collided. Iluskisson was taken to 'Wellington Hospital with a broken leg. and died in the institution on Nove-m her 24 after an operation. After a retirement of four hours the jury found—(l) Defendant was guilty of negligence bv driving at- an excessively high speed; (2) C'rofr’s gig was not properly lighted; (3) the collision was caused by defendant’s negligence, and also by reason of the gig not- being properly lighted ; (4) lluskisson’s death was not- the natural or probable result of defendant’s negligence; (5) the death was not- caused by negligent treatment at the hospital; (6) plaintiff was entitled to receive damages amounting to £BSO. As a. result of the jury 6 answers counsel for both plaintiff and defendant moved for judgment. " His Honor said he would let the case stand over pending decision on the motion for judgment, and he adjourned the matter for further consideration.
