CONVICTION QUASHED.

WELLINGTON, November 28. The reserved judgment of his Honor Mr Justice Hosking was delivered in Palmerston North in connection with an appeal case heard in September, in which Thos. Augustus Petherick appealed against the decision of the magistrate (Mr Page). In Dannevirke in May last Petherick had, been charged by the police with having wilfully damaged the electrical installation of the Arcadia Picture Company in Dannevirke by severing an electric wire. The_ magistrate had entered a conviction, and imposed a fine of £5. The basis of appeal was that the evidence was not sufficient to warrant a conviction, and his Honor supported this view and allowed the. appeal.
