CASE OF UNDERSELLING.

CHRISTCHURCH, May 5. In the Supremo Court to-day Mr Justice Herdman gran-ted an injunction against G. H. Stockdale, second-hand dealer, restraining him from selling second-hand Edison phonograph records below the listed price. The Thomas A. Edison, Ltd. (the plaintiff company) had written to defendant forbidding him to sell below the listed price, according to the conditions printed on the boxes, but the defendant continued to make sales at the lower price, and expressed his determination not to stop. His Honor held that the plaintiffs had the right to impose conditions of sale, and referred to the decision of the Privy Connoil in the case of the National Phonograph Company of Australia v. Manck in support of his judgment.
