COMPENSATION CLAIM.
QUESTION OF LIMITATION. WELLINGTON, September 28
The Court of Appeal this morning heard argument in the case of Robin versus the Union Steam Ship Company. The case raised the interesting- and_ important point whether in an action against an employer by a wife or mother, the dependent of the deceased servant, who met his death through the negligence of a fellow servant, damages are unlimited, or whether the damages are limited to £SOO. The question turns upon the construction of section 62 of '" The Workers' Compensation Act, 1908," as amended by eection 13 of the amending Act of 1911. The claim is for £IOOO by the plaintiff, as daughter of the late John Robin, who died as the result of an accident on the steamer Wanaka on April 2, 1917. Th e defendant issued a summons to amend the claim by reducing it to £SOO. Mr Justice Hosking dismissed the summons, and defendant now seeks to have that decision reviewed by the court. Decision was reserved.
