NEW ZEALAND APPEAL CASE
LONDON, July 8. In the Privy Council the case Rutherford v. Acton Adams, a New Zealand appeal, was dismissed with costs. CAUSE OF ACTION. CHRISTCHURCH, July 9. The case of William Acton Adams (plaintiff) v. Duncan Rutherford (defendant) originated at the Supreme Court in Christchurch, the plaintiff issuing a writ for £3570 in respect of the purchase by the defendant from him of certain farm properties. The case came on before Mr Justice Denniston, and after partial hearing was removed by consent into the Court of Appeal. On January 31, 1914, the Court of Appeal, in a majority judgment, decided in favour of plaintiff for the amount claimed. Against this decision the defendant (appellant before the Privy Council) appealed, the main question raised in the appeal being whether the appellant, as purchaser from respondent, was entitled to a deduction from the purchase money by reason of alleged material misrepresentations as to the extent of the fencing on the property agreed to be sold.
