ALLEGED FORGERY AND UTTERING.
HAMILTON, June 11. A casa disclosing extraordinary circumstances was heard before Mr Justice Cooper and a common jury at the Plamilton Supreme Court, where a middle-aged man, John Johnson, of Kawhia, was charged with forgery and uttering. According to the evidence for the prosecution, the prisoner, on leaving the employ of a man named O’Shelboy, received a cheque for £5 ss. This, on presentation at the bank by a person resembling the prisoner, was altered to £ls 15s. During the proceedings in the lower court the justices’ clerk (who was the local constable) went into a private room. Accused and another man who had been taking the depositions were left in the court, along with the documents relating to the prosecution. While the man referred to turned his bade to close the door he forgot tho cheque fopyj-ng the basis of the charge, which disappeared, and it is assumed that it had been swallowed by the prisoner, as no trace of it could be found. Tho jury disagreed, and a new trial ordered.
