When the jury assembled to-day it w*as announced that' one of the jurymen . had been taken ill at his residence, and - was unable to be present. ' Counsel on both sides filed an agreement, signed by the Crown Prosecutor, both the accused, * and both their counsel, agreeing to Accept the verdict of the remaining 11 jurymen. This course was taken under '.' The Crimes Act, 1908," compiled lately. When the evidence for the Crown dosed in the Otira robbery case, counsel for the . defence asked his Honor if the case should go before the jury. Mr Justice Cooper replied that it was exceedingly weak, but he would not undertake the responsibility of withdrawing it from the jury. He left it to themselves . to decide whether t_.y desired to hear the defence of the accused. The jury decided to acquit the men without calling on the defence, and they were discharged.
