MacGregor foi defendants.— The question; was whether the sea water had entered the ship throueh seams in tli©^ deck, <*twed byj heavy weather, or from a pipe, of wixidh the cap had been carlessly left unscrewed on one> particular occasion in heavy weather. — The Magistrate came to the conclusion on tha facts that the evidence established that ma Be» water, whioh Tinckrabtectly hiad injured! the borax, had got into the cargo through! seams in the deck. He accordingly found that the injury was caused by "an accident of the sea," within the meaning of the bill of lading and gave judgment for the Uefenoants, with costs (£5 18s 6dJ,
