THE KILDARE HILL CLAIM.

MORE LITIGATION. (Fjiom Ottr Own Correspondent.) ST. BATHANS, December 2. The attention of Mr George Cruickshank, -warden, was to-day engaged at St. Eathans with an application by the Scandinavian Water Race Company for John Swing's Kildare Hill claim and for a certificate of abandonment. Mr Cutten appeared for the company, and Mr Ewing° conducted his case in person. The grounds upon which abandonment was sought were that default had been made for 12 months in the due and punctual payment of rent, and that the claim had been neglected. The warden decided that he could grant a certificate of abandonment, biit stated that, as it had been brought to his notice that Mr Ewing had also applied for the ground, and as Mr Ewing was not prepared to go on juet now; he would adjourn the application for the claim until next court day, so that both applications might be heard together, and the merits of each gone into. The application was adjourned to the 16th, Mr Ewing to pay the costs of adjournment (£5 9d. In the course of the proceedings Mr Ewing mentioned that the protracted litigation _in connection with this claim had already cost him over £300.
