A SHARE CASE.

A case came before Mr Warden Burgess at Roxburgh on Thursday, when Mr R. Cockburn, sharebroker, sued Mr John M'Ghie, of Dunedin, for £li 10s 6d, amount of 25 shares in the Dunedin Gold Dredging Company. Plaintiff gave evidence to the eiiect that M'Ghie instructed him to buy 25 Dunedin shares, and that he drew on him when the transfer" came through. The bank returned the draft, and, after some correspondence, in which M'Ghie asked for time, the latter a«i'lly declined to pay. The defence was that defendant lodged the money in the bank and took the transfer, hut on proceeding to the company's office and finding there was no scrip there -he withdrew the money and returned the transfer and claimed that he had lost a sale for the shares owing to the scrip not being there.- The Warden said he believed the delay in this instance in the scrip being sent to the office \vas caused by plaintiff wishing to oblige defendant, 1 but as- -he "raised this legal point, although it was not very creditable on defendant's part, yet he had no option but to 'give judgment for defendant, with costs out of pocket, 18s; professional costs refused.
