Court civil sessions a decree nisi was granted dissolving the marriage of Samuel Marks, restaurantkeeper, of Queen street, Auckland (petitioner), and Ellen Marks (respondent).The decree was granted under subsection 3, section 3, of the amending act, 1898,on the grounds tha*- the. wife during four years and upwards had been an habitual drunkard, had habitually neglected her domestic duties, and rendered herself unfit to discharge them. This was the first casa under the subsection that has been heard in this colony. The respondent did not appear.
