An Opinion Wanted. TO THE EDITOR.
Sic, — Would you kindly give me an opinion in your sportiDg columns upon the following :—: — A horse runs second in a race (Maideu Trot) in which there is second money (£3). The name horse comes oat later in the day in another race (Two-mile and a-half Trot), aud wius. A pro-tpf-t is entered on the ground of fat ff running in the Maiden, and the horae is disijua'iQe'l for that race (the Two-mile, and a-half I'ro'j) Subs' quently a claim is laid by the third borne in the Maiden Trot for the seof-nd rnoi ey. The club basfd i!s decision on Rjle 132 of the racing rulen, it being the oiily rule at all applicable to such cai-es | Ido not know — auM in fact Ido not think — that they have any precedent to go upon, and I
submit that they have given a wrong interpretation to Rule 132, and I intend to thresh the matter out. I submit there is no rale in the racing rules at all Applicable to the case, and that Rule 132 merely applies to the race wherein the objection is raised — that is, the race won, and tbat the word "such " entirely governs the meaniug of the rule, meaning l> sach" race whereiu the objection was raised and thereby the race wod, without in aay way relating to prior races. The late meeting of the Jockey Club was not fully attended, and I consider myself that they hav<s made a misinterpretation of the rule, and that I am juet as competent as they in such a matter, and I intend to fee the matter out. — I am, &c, B. Gerkiss. [The horse was not disqualified for stiff running in the Two-mile and a-ba'f Trot, but for s' iff running in the Maiden Trot, a prior race. Rule of Rucing 132 governs the case.. The words "such race" apply to the race for which the horse was disqualified. He is consequently out of the race altogether, and is not entitled to any part of the stake for the Maiden Trob. On being applied to, I find the metropolitan clab has, decided this case in accordance with Rale 131, and there is no appeal against such decision. — Ed. O.W.]
