Porter had laid totalizator odds on the Kiccarton course on .November 8. ■ He way arrested by Detective O'Conuor) convicted at .the Christ enurcb Ke.-iileiit Magistrate's Court under section JBof the Gaming .and Lotteries Act of"; uulawlully. conducting a scheme by which prizes of money weire competed, for by mode of chance, to wit, a horse race, and he was fined £25, au<lr appealed.' It bad been contended; for appellant that a voluntary selection by a person of a horse within appellant's, scheme 1 , depending upon the skill and knowledge of that person, was not a mode of chance. Mr Justice Johnston pointed out that the toialisator itself is declared by the Bth section of the act to be an instrument of gaming within the meaning of the act, uul<-.-s UM'd in couformity with the act. He had no doubt that appellant's sclieme,\vhich had all the elements of chance which the tota!isator had, was a.schfme for gaining a prize by a mode of chance, and tbe license to use the totalizator could not be invoked as - legalising a scheme referring to thf ' dividendg declared on it.' j The words' of section 18, "Competed for by lot, dice, or any other mode of chance," were not to be confined to modes ejusdem yeneris with, lot or dice. H« quoted Chief JuHiict 1 Cockburn's opinion, that ther« bfing.au element of chance in' a transaction among parties betting by totalisator on a hoi he runt*., Miub- wagering might properly be termed a game of <hance. 'the name writer Says that tht nominations for the Great Northern Derby, to be run at the Auckland Kaciug Club's Summer Meeting, of 1888-89, have now made their appearance, which show that 73 youngs4ers compose the list. Though satisfactory,' there is no disguising the fact that a inuoh . larger number of entries were expected from Australia. The race had been most liberally advertised there, but the answer is the pitiable one of five nominations three being iti the/name of Mr C. S Agnesv, of Tastaauia, and twoju that of Mr S. Gardiner, of Victoria. Considering the manner in which tbe race was brought under their notice, the small number of Australian eutries can be explained in no pttufc way than that tbe breeders awns the wai^r are loth to expend auy money 8.1 Sew Zealand nomiua ions. At a piblio meeting at Ertrick to re-ori;an.ise the Gttrick D tin tin Jockey Club, the following gentlemen were app tinted stewards : — Messrs W. Waugh, Brazil, Bowden, Jimes, Graham, Richards, J. Benuet, secretiry and treasurer, Mtissra Bowden, James, and D. Robertson were appointed handicapper ; and Messrs Rickards and James a works committee to repair the course, &c. It was decided that all races bhould b« for horses owned within a radius of 15 miles from Banger creek crossing at Ettrick ; horses aud owners to be resident in the district three months prior to date of races, and horses to have never been trained in clothng. A grass fire, supposed to have been started by boys, broke out on Mondny afternoon , in the Ellesmcre racecourse and Domain reserve, t-ays thttPreHs. Nearly all the gras.s whs destroyed tucl about 20 chains of- plantations, besides several chains of fencing At oue time the. Situes extended for about a mile in length, and it was -feared that it would reach Messrs M'Efennie'B, Upstqn's, and Young's homesteads. Fortunately a number of men were harvesting in the vicinity, who by the aid of boughs beat the fire out. It is estimated that about £150 Worth of damage was done. For Waiau raoes, on ijarch 11, a programme has been prepared showing that about £60 will be given in stakes. At a recent meeting of the cpmmittee of the Timaru Tra'-lesmens' Racing Club the coarse Was reported, to be in good order, with the exoeptiou of the feuces, which waut repairing. Owing to the difficulty in describing the colours worn hy the jockeys on the race cards the secretary whs instructed to getsqme numbered badges Made, to be worn by the riler during tho race, tho number to correspond with the card. It was decided to use most stringent measures should any bookmakers lay totalizator prices at the race meeting, ; The nominations for the Napier Park Cup, to be run for at the Autumn meeting, number over a score, and there are some good horses among. thtm— suoh as Pasha, Waitiri, Pearl, Administrator, Spade Guinea, Tigridia, Silence, and Apropos. Taranaki entries are good all round, and here *ho we find the names of Pearl, Tigridia, Waitiri, Pasha,' and other .cracks. The appearance of Mitrailleuse's name among the Taranaki nominations seems, to that tois speedy mare will return, to this country as •oon as the V.R.C. meeting is over. At the annual meeting of the shareholders of the Canterbury Plumpton. Part? Company toe report of the directors upon last -year's working was adopted, and upon their reoom* toendatiou it was resolved , that the unissued capital, consi-stinj? of 2200 shares of £1 each (out of a total of 4000 shares, of which 1800 were previously issued and have been paid up), should Dow be offered to the public. A RACE MEETING IN FIJI. The Cakdudrove Race meeting "was held at Taviuni. ou the 23rd and 24th of last December. The fir.it race was the Taviuui Stakes, a. mile hau.lictip, open to all comers. 'First prize, £8; neeon<l,.£2. This was won by Z.»e, Consent second, 'and "Decision third. Decision jwas tht- - winner of the Cakaudrove Cup of '85, (-6 he carried l'3-»t- by way <>f penalty. The Fiji Times reporter naively remarks that the weight wa^ too much for D -cituou. The next rate— Hurille Handicap, a mile, first prize, £5 ; second, £2—2 — was also won by Zoe. The third event was a Hurry' Scurry, one mile, the last horse to pay £L to tbe funds. This was won by Emperor. The last < vent on the programme was '•Cigar Race.— Five shilling sweepstakes ; \ mile, for all beaten horses. Horees to stand with tail* to starting post, then saddle, light cigar and finish with it alight. Robert the Devil won this, being apparently a good smoker." "On the secoud day the Cakaudrove Cup was run, and was wou by Decision, who carried I3st. The speedy Zoe won the Hurdle Race and Planters' Purse, aud Dolly won the Consolation. The nexb'eveut' is so funnily described rhat I ("'Martini") shall give the reporter's "vpsissima verba.' Thus he states' his case :— * 14 Quadruped Race.— Distance $ a mile, ssveep- - stakes of ss, riders to draw lots for quadruped*, and no ruler to draw his own ; the last one to be declared the winner. , J: V. Tartes mule, Jack ... ... 1 W. M. Moore's mule, Jenny ..; ... 2

This was the most uproarious event of the ineeting. -All got away on even terms, the horse taking a decided lead, and the mules plodding carefully in the Tear. Each rider made most praiseworthy efforts to leave his own horse last, but in that distinction Jack and Jenny were not to be denied; but Jenny having run inside a post and Jack not finishing, a protest was entered and the two had to run it off, first past the post to win. This again caused great merriment, and when they made their final effort Jack finished in gallant style, carefully followed by Jenny amid great cheering. Time, \of an hour. The last event was M'Ewen's Cup, *a two-mile flat race,' says the -Times, • for residents of Cakaudrove, owners up,? Consent won this, and the meeting terminated." -
