THE LIABILITY OF STEWARDS OF RACES Auckland, July 12.

At Cambridge Court to-day an interesting case,' Brindle v. Buckland and others, was heard, shoeing the non-responsibility of stewards and officers for the payment of stakes. "Mr Hay for the defendants. Plaintiff claimed '£9 lOs, the amount of stakes won at tbo Piako Turf Club races on 30th November last by his horse- Robert the Devil. Plaintiff stated he had applied for the money to the secretary of'the Club, Mr George Smith, of Morrinßvilio,vwho had said that the money should be paid when tho race subscriptions were got in. ' Messrs Buckland, Evans, Turnbull, and Breakell were now summoned as stewards, but each, when Bworn, stated that their names were placed on the list of stewards without their consent and in their absence. A letter waa produced by the latter frdm the secretary , of the Club Btating that he could not get subscriptions in or ho would settle tho claim. Mr Hay argued there- was no contract between defen-\ dants.and plaintiff. He quoted authorities to ashow that even had defendants been proved to bo stewards they were not liable, not being stakeholders, 'and that even the stakeholder himself was no.t personally liable for the stakes until he had himself received possession of the money. Judgment was given for defendants, with costs £8 3s.
