Refusing to siove on.— Richard Turner was .charged by Warder Campbell, the officer in | charge of the hard labour gang of prisoriera at Port Chalmers, with having, on the morning of I the 26th instant, loitered about the 'road at Carey's Bay, in the vicinity of the, prisoners. I and when ordered, to leave, refused. — The defendant pleaded' Guilty of being on the road. — Warder Campbell deposed to the facts of the case. The defendant, by his presence, interfered with the prisoners, and 'refused to move on when ordered to do so. — Martin Itin'g, an I employe of the Dunedin Gael, said he was standing in. front of Dench's Hotel' at Carey's ! Bay on the morning in question. A lady came j along and told him some men were" askiqg some oi the prisoners to go into the baa* and drink. Wicness went round and warned the defendant not to interfere with the prisoners, to which' defendant replied, "We know all' about it." Witness then walked away, and as he' was'going heard abusive language from one of the men. Warder Campbell then came along. — Sergeant Hanion said that was tie evidence, unless the Bench did not think it strong enough to convict upon, in which case there was the evidence of the lady in question. She, "however, had a great objection' to' appearing; but if " the Bench liked a subpoena could be issued. She would be able to state that the prisoners were asked by the defendants and other two men to go into the bar and driuk, — His Worship explained that it was 'most important the case should be further 'gone into.—^Sergeant Hanion asked f6r a remand.— His Worship directed that the other' iwo men should be called and charged, whereupon James M'Huga and Martin M'Mahon were charged with loitering on the road near the prisoner?,' ani r3fusing to leave when ordered to do so.
