Tuesday, Di:c. 6. (Before J. 11, HAitrus, Esq., Distiict Judge.) Seven cases were disposed of, involving no point of importance.

IHRTLEY V. CAMTBELL

Robert Rartlej, ot'Noith Taieri, sued Alexander Campbell for the sum of £55 Bs., being for board and lodging, and other items. A set-off, amounting to jglOO Bs., was put in.

Mr. T. B. Gillies appeared for the plaintiff, and Mr. Ho worth for the defendant.

It appeared from the evidence that defendant' intending to go to the South with " Old Mack," went meanwhile to reside in ihe family of plaintiff, wbeie be lemained for a considerable period, "While theie be did some trifling jobs to amuse himself, such as attempting to make a sofa of lough slabs, a chair and table of similar materials, &c. The defendant did these thingb voluntarily, never bavin? been asked or required to do so. Plaintiff's house was supposed to have been erected partly on a load line, and partly on waste lands of the Ciown immediately adjacent to his farm. During the defendant's lcsidence uith plaintiff, the foi mer purchased land adjacent to that on which plaiiitid '.s house and g irden stood. The defendant's set-off contained charges for peifoiming the jobs before-mentioned, the use and occupation of house and garden for nearly two years, and various other matteis. The Juiy letumed a verdict for plaintiff for £35, with costs.
