' Friday, May 380, 1895. (Before Messrs S. A. Breach and G. W. Gace, J*PVs.) Mrs Espagne v. A.H. Moore. Mr Bailey for plaintiff. ■ This was an action for the recovery of certain documents, and £5 dafmages. Very voluminous evidence was taken, which went to show that' Messrs Pellew and Flynn had leased. certain s<*"■ raises iu Opunake from Mrs for a term of five years. ment to lease was drawn Mr Moore, who was Mrs Espagne*®: agnate*' for the property for a time. There was only one copy of the lease executed in each instance, and: these were left in Mr Moore’s ,custody for safe-keeping. The plaintiff now claims possession of these, and Mr Moore declines to give them up, claiming that he holds them jointly for lessor and lessees, and the lessees "object to him handing them over. The case occupied the Court nearly the whole day, and their Worships re* served judgment till next Ganrt'day. Harvey v. Pelham. This was an action to recover possession of a tenement at Rahotu. «,The Bench held that they bad no jurisdiction in the case, which therefore stands adjourned until the. S.M# sits. ’
