WAIHI ASSAULT CASES.

CONCLUDED LAST NIGHT. cask against dklaney "dismissed. NO CONVICTION RECORDED. ADJOURNED FOR THREE MONTHS. [By Electric Telegraph.] Waihi, This Day. The charges of assault between Jessie Beames and- James Delaney were concluded last night. In giving judgment the Magistrate said he would deal first with Neil's case. The two principal parties were .Delaney and Beames, and Neil came in almost at the finish. Neil had candidly admitted that under similar circumstances he would have done as Delaney had done, and he (Neil) did not blame Delaney for hitting him. Neil-had been candid in giving his evidence. Neil had . committed a technical assault in the honest belief that Delaney was likely to injure the girl. _Xhe Magistrate said he wouJd ad-" journ the case for three months, but that ii within that period Neil failed to keep his word that he would desist 'frojn " booing" and " scabbing " he would be j called up for sentence. In connection with the counter charge for assault brought by Delaney against Jessie Beames the Magistrate briefly i reviewed the evidence. He could not ■ get away from the tact that the girl had on a previous occasion asked Sergeant Miller to let her by in order to get at Delaney and his wife. She had also been previously Warned about using a hat-pin. With this in his mind it was difficult for him to reconcile the evidence given by the girl. It was a question whether Delaney's foot hit the ! girl or the girl hit his foot. Delaney was walking home with h;s children,, carrying one of them in his arms, and under these' circumstances it was . not likely that he would bz looking for trouble, and he was justified in protecting them. In conclusion the Magistrate said he would impose the same conditions as he had in Neil's case, and re-

quest a promise horn her riot to engage in "booing" and calling out " scab." There would be no conviction, but'he would adjournihe case for three months on the understanding that her promise would be kept, otherwise at any time within that period she would be called up for sentence. In regara to the charge against Delaney, he would dismiss that straight out.
