(Before E. S. Bush, Esq., S.M.) Frederick Alley v. H. 0. Pickering, \ claim £45. — Mr Porritt for plaintiff, and' Mr Jackson for defendant.—Mr Jackson said that lie received a letter from a Fielding solicitor, where defendant now lived, stating that an application had been made to have defendant's evidence taken at Fielding on the 23rd inst. —Mr Moresby said that the letter had not yet been received. —Mr Jackson asked that the j case be adjourned. — The case was adjourned to next Court day. j Ohinemuri County Council v. A. Berridge. — Mr Porritt for plaintiff, j and Mr Moss for defendant. — Adjourned by arrangement till May 26th. j Wni. Rogers v. Waitekauri Ex- j tended G-.M. Co., claim £135. —Mr McVeagh for plaintiff and Mr Jackson for defendant.—Mr McVeagh said that the account wai objected to as being excessive, and plaintiff and the company's manager had met and arranged that £21 should be deducted. £114 had been paid and a receipt given. Nothing, however, was .said about costs. He would ask that costs be allowed, —Mr Jackson objected to this, as the action had been amicably settled without the presence of a solicitor. —Mr McVeagli held that it was similar to the arnouut being paid i into Court. —The S.M. held that it was not ja parallel case to one in which the money had been paid into Court. In this case the principals had met together and arranged on an amount, whicU had been accepted, and he thought this must have been in settlement of everything.—After discussion Mr McYeagh withdrew his application for costs.
