Validity Of Airways Regulations LIMITATION OF DAMAGES PA ' WELLINGTON, Apl. 3. The 1 Appeal Court today commenced the hearing of the appeal of Merva Sheldon Jeune widow, of Wellington, against an order made by the Chief Justice,: Sir Humphrey O’Leary, on October 14 last year in the Supreme Court at Wellington whereby her claim against the New Zealand National Airways Corporation in respect of the death of her husband, James Frederick Dudley. Jeune, a civil servant, in the crash of the Kereru aircraft, near Waikanae on March 10, 1949, was reduced from £15,000 to £SOOO as a result of the Chief Justice ruling that the 1947 regulations made under New Zealand National Airways Act, 1945, were valid. By regulation these claims are restricted to £SOOO. It had been contended by Mrs Jeune that the regulations took away a common law right of resort to the courts. The corporation is represented by Mr D. W. Virtue, with him Mr J. C. White. „ „ „ . Qpening for Mrs Jeune, Mr C. A. L. Treadwell, who has with him Mr W. L. Ellingham," stated that this was in the nature of a test.case as several claims in respect of the same accident were pending. The hearing is proceeding.
