DRAINAGE BOARD NOTICES D UNEDIN DRAINAGE AND SEWERAGE BOARD. NOTICE OF CONFIRMATION OF SPECIAL ORDER AUTHORISING RAISING OF CONVERSION LOAN, SECOND REPAYMENT LOAN, 1950. OF £197,000. PUBLIC NOTICE IS HEREBY GIVEN that the Dunedin Drainage and Sewerage Board, at a Special Meeting convened for the purpose, and held on MONDAY, NOVEMBER 14, 1949, passed the following Resolution, viz.:— THAT WHEREAS under the authority of Clause 16 of "The Dunedin Drainage and Sewerage Board Loans Conversion Order, 1933,” it is provided in certain of the securities issued pursuant to such Order for the redemption thereof at the option of the Dunedin Drainage and Sewerage Board on such date prior to that specified in the said securities as the said Board might fix by Notice in that behalf published in the New Zealand Gazette at least three months before such prior date; AND WHEREAS the Board has, m exercise of the said option duly given Notice in the Gazette of its intention to redeem on the Ist day of APRIL, 1950, certain of such securities amounting in the aggregate to the sum of One Hundred and Ninetyseven Thousand Pounds (£197,000), the date for the redemption of which is specified in such securities as the Ist day of APRIL, 1953; AND WHEREAS the Board, in order to give effect to such intention, has determined to raise a Loan of One Hundred and Ninety-seven Thousand Pounds (£197,000) in terms sanctioned by the Local Government Loans Board, the said Dunedin Drainage and Sewerage Board Hereby Resolves as follows, so that this Resolution may be confirmed at a subsequent Meeting of the Board, and operate as a Special Order, viz.:— 1. THAT the said Board Hereby Resolves, in pursuance and exercise of the powers vested in it in that behalf by “ The Dunedin District Drainage and Sewerage Act, 1900,” and its Amendments, and of every other power in- that behalf enabling it, to raise a Loan of One Hundred and Ninety-seven Thousand Pounds (£197,000); hereinafter referred to as " the proposed Loan on the terms hereinafter provided, viz.:— 2. THAT the said proposed Loan be lrnrvu.n ac the "Dunedin Drainage known as the ,r Dunedin Drainage and Sewerage Board Conversion Loan Second Repayment Loan, 1950,” and shall be raised for the purpose of repaying portion of the Dunedin Drainage and Sewerage Board Conversion Loan, 1934, as hereinbefore set forth. 3. THAT the security for the payment of the interest and other charges on the said proposed Loan shall be an annually recurring Special Rate of One Penny (Id) in the Pound (£) upon the rateable value (on the basis of the annual value) of all rateable property of the Board’s district as defined by the aforesaid Act. 4. THAT the term of the said proposed Loan shall be Three (3) Years from the First (Ist) Day of April, 1950. 5. THAT, with respect to the provision for repayment of the said proposed Loan, the proviso to Sub-section 3 of Section 32 of “ The Finance Act, 1938 ” (as set out in Sub-section 2 of Section 29 of “ The Finance Act, 1941 ”) shall apply, and accordingly the provisions of Sub-clause 2 of Clause 20 of " The Dunedin Drainage and Sewerage Board Loans Conversion Order, 1933,” shall be construed as if the debentures, amounting to £197,000, redeemed on April 1, 1950, had not been redeemed as at that date, but had been redeemed on April 1, 1953. 6. THAT the said proposed Loan of £197,000 be raised by the issue of debentures in the form prescribed hxr 'Rrvnrri’c: Ante nhnvpmpnWnnp.fi bv the Board's Acts abovementioned and bear interest at a rate not exceeding Three Pounds (£3) per centum per annum. Such interest shall be payable half-yearly during the currency of the Loan, being a period of Three Years, or until the Loan is fully paid off, and coupons shall be annexed to such debentures accordingly. The said debentures shall be payable at any branch of the Bank of New Zealand, within New Zealand, free of exchange, to the holders thereof. 7. THAT the Corporate Seal of the Board be affixed to all such debentures and that all such debentures and coupons be signed by the Chairman and the Secretary, provided that, with respect to the coupons, the signatures thereon shall be lithographed.
