Lengthy evidence was heard by Mr J. D. Willis, S.M., in the Magistrate’s Court yesterday morning in a claim arising out of the overhaul of a tractor and subsequent repairs to the machine. James Ross McKerrow, farmer, Waiar.akarua, claimed from A. E. J. < ™ hu rcn, trading as A. E. J. Church and Co., £26 16s lid, the amount owing by him to Bruce Christie and Co., for repair work done by the company to plaintiff s tractor The statement of claim alleged that this repair work was necessitated by the negligence and/or lack of skill of tne defendant in that when overhauling plaintiff's tractor he removed five shims, thereby causing the crown wheel of the tractor to be too tightly meshed with the pinion and become damaged beyond repair and also causing other consequential damage. Mr C. Zimmermann appeared for the plaintiff and Mr J. H. Main for the defendant. The amount set down in the claim was admitted by the defence to be reasonable for the repairs Evidence was given by Arthur Docherty and L. CJark, and the hearing was adjourned to June 15.
