LIEN CLAIMED
WORK FOR BANKRUPT A lien for £276 17s was claimed by J. and T. Christie, Ltd. (Mr K. W. Stewart), in a civil claim brought against the official assignee (Mr Adams), begun before Mr H. W. Bundle, S.M., in the Magistrate’s Court on Tuesday. The statement of claim said that on the date that James Wallace Raymond Easton was adjudged a bankrupt he was indebted to the plaintiff for plumbing and drainage work at a cost of £276 17s. A verbal contract for the plaintiff toinstall plumbing at a house being built bv Easton for his own occupation was made in August, 1947, said Mr Stewart. By November the work had not been completed, since a porcelain bath was not procurable at that time. Easton was adjudicated a bankrupt in February The plaintiff served notice for the claim of the lien with the official assignee. Such a notice was required to be served within 60 days of the completion of the contract, or alternatively before its completion. The palintiff’s case rested on the submission that the work was not completed at the time, since it did not end until the bath temporarily installed was replaced by the porcelain enamel bath that was ordered. Evidence concerning the specifications of the work was given by William H. Christie. He was cross-examined at length as to the type of bath that was specified or implied in the specifications for the work. • After re-examination of the witness, the hearing was adjourned until Friday.
