CLAIM REFUSED BY MAGISTRATE “ I am not justified In making an order for possession .on the evidence placed before the court. Perhaps matters can be arranged between the parties,” said Mr H. W. Bundle, S.M., in the Magistrate’s Court yesterday, when John Howrie Muir (Mr R. C Rutherford) sought to recover from Florence Gibson (Mr C. J. L. White) possession of a dwelling at 19 Kaikorai Valley road. In his summing up, the magistrate said that the plaintiff (the landlord of the property) wanted to make alterations to the building, which consisted of' a shop and a house. The defendant occupied the house The question was whether the landlord was entitled to possession. Living in the house were the defendant, four daughters and a son. "In some ways it is an excellent thing for the plaintiff to make alterations and provide another flat for a separate family when the present housing shortage is considered,” Mr Bundle added. ” However, there is the question of inconvenience to the tenant while the alterations are going on to be considered." Undefended Cases Judgment by default for the plaintiffs was entered in the following cases:— National Insurance Company v. T. J. Butler, for insurance premiums, £8 16s 7d, with costs (£1 15s 6d); H. and G. K. Neill, Ltd., v. A. Pearson, for goods supplied. £1 7s 6d, with costs (10s).
