LEASE OF HOTEL
LOWER COURT'S DECISION REVERSED
Judgment has been given by Mr Justice Kennedy in an appeal on point of law by Mary Smith, of Oamaru. against a decision of the Magistrate’s Court in Dunedin. The respondent was Geoffrey Charlton Simmonds. In the Magistrate’s Court on December 9. 1946, Mr H. W. Bundle, S.M., in a lengthy written decision, gave judgment for Simmonds, who had been proceeded against for the sum of £197 3s 4d for rent alleged to be due for the lease of the Victoria Hotel, Cromwell, from September 1, 1945, to April 1, 1946. At the hearing of the appeal in March last, Mr G. T. Baylee appeared for the appellant and Mr J. C. Parcell for the respondent. 1 In his judgment, Mr Justice Kennedy stated that the broad question related to the proper interpretation of a clause in the lease of the hotel. He allowed the appeal and entered judgment for the plaintiff for the full amount claimed and costs.
