CLAIM BY SHOWMAN
APPEAL DISMISSED SEQUEL TO COLLISION A showman, Lawrence Arthur Staig, of Wellington, proceeded against John Rennie McCulloch, a farmer, of Ngapara, in the Supreme Court yesterday morning before Mr Justice Kennedy on an appeal from a decision of a magistrate at Oamaru in a claim for £lO2 for damages arising from a collision between a motor lorry driven by the appetlant and a car driven by the respondent The appellant claimed £BO as loss through allegedly being unable to fufil nis engagements as a showman at the Balclutha Show on November 30 1945, £2O for alleged damage to his show equipment—a motor cycle and steelwork for an exhibition cage—and £2 for repairs to his vehicle The magistrate in the hearing at Oamaru found for the defendant McCulloch The appellant, for whom Mr. 1. B Stevenson appeared, alleged that- the accident was due to the negligence of the respondent In falling to observe the hand rule Mr E J Anderson appeared for the respondent. After hearing legal argument, his Honor dismissed the appeal, and awarded costs totalling £l2 12s to the respondent.
