BREACH OF CONTRACT

AUSTRALIAN RAILWAYS NEWSPAPER FREIGHT REFUSED (Rec. 1 p.m.) SYDNEY, Aug. 15. Ruling that the Railway Department had committed a breach of contract by refusing to carry newspapers, the Supreme Court awarded the proprietors of the Sydney Morning Herald £3,937 damages against the Commissioner of Railways. The verdict wa's for the full amount the company estimated to be its loss resulting from the railway’s refusal to carry, during the newspaper, dispute of October, 1944, the emergency issue of the Herald incorporating Sydney’s other three daily newspapers.
