SHARE OF PROFITS

SUPREME COURT ACTION The distribution of shares in Associated Chemists, which conducts the All Night Pharmacy on behalf of the other Dunedin chemists, was the subject of a claim brought by Robert Merrett Wilkinson against Associated Chemists in the Supreme Court yesterday before his Honor Mr Justice Kennedy. Mr H. Brash appeared for -the plaintiff, and Mr J. M. Paterson represented the defendant company. Mr F. B. Adams appeared to watch the case on behalf of the Crown

It was explained that an order made under the Shops and Offices Act laid it down that as a condition of Associated Chemists being exempted from the usual closing hours all contributing chemists were entitled to share equally in the profits of that concern. The plaintiff had two shops and claimed to be entitled to a share in respect of each shop. He sought a declaration on those lines and also a declaration that the order of the Minister of Labour exempting Associated Chemists from the closing hours was invalid because he had not satisfied himself that every chemist was afforded the right to share in the profits of the concern. The whole of the day was occupied in'legal argument, and the hearing was adjourned until Monday.
