OBJECTION BY CROWN

UNDUE AGGREGATION SUGGESTED

An objection by the Crown to the transfer of a city property on the grounds of alleged undue aggregation on the part of the purchaser was heard by the Otago Land Sales Committee— Messrs E. J. Anderson (chairman), D. J. Ross, and R. Walls —yesterday, when George Paul (Mr M. M. Caudwell) sought permission to sell to Evelyn Isobel Scully (Mr J. T. Walter) a dwelling situated on section IA, block 66, City of Dunedin, for a consideration of £650.

The purchaser, in evidence, said she owned a small farm in South Otago, and also two house properties in Dunedin, one of which she occupied. It was her intention to give the properly in question to her daughter, who was about to marry a serviceman, who had recently returned from the Middle East.

Mr W. L. Miller, for the Crown, said that there was a considerable demand by working families for properties of the type involved in the application, and it was the Crown’s view that aggregation became undue when persons who already had sufficient property for their own purposes acquired further property, thereby depriving others of the opportunity of owning their own homes. The purchaser could provide a home for her daughter by financing a purchase, rather than acquiring a property in her own name. In reply to a question by the chairman. Mr Miller submitted that the Land Sales Act, as it affected returned servicemen, applied to rural properties and not to city residences, in the acquisition of which servicemen were not entitled to any particular preference.
