INQUISITORIAL POWER CONDEMNATION BY CHIEF JUSTICE (P.A.) WELLINGTON, July 4. “It makes one indignant to see power like this taken,” said the Chief Justice, Sir Michael Myers, in the Supreme Court yesterday; commenting on the clauses of the Finance Act (No 3), 1943, which give the Treasury, the Comptroller and Auditor-general the right to inspect.and examine the books of persons having contracts with the Government. “Here a law draughtsman or the Auditor-general drafts a clause of .an inquisitorial nature which gives the Auditor-general or Comptroller tne right to go into any firm and demand it to produce its books,” His Honor proceeded. , . “You won’t get me, or any court, to interpret these powers so widely. It is the duty of the court to protect that freedom which, we prate about so much and for which the United Nations are fighting. A limitation could quite easily be stated by the law draughtsman.”
