Monday, November 15 (Before Mr H. W. Bundle, S.M.)

Failure to Report

Alexander McLeod, aged 46, a waterside worker, who appeared on remand, pleaded guilty to a charge of failing to report to the military authorities for medical examination as required by the National -Service Emergency Regulations.—Seniorsergeant Vaughan stated that the accused was called up for service in 1940, but he was held on appeal by the Union Steam Ship Company, by which firm he was employed, until March 31, 1943, when the appeal was dismissed. While he was held on appeal, he deserted from his ship in August, 1942, and had since been working on the wharf.—Mr J. D. More, who appeared for the accused, said that McLeod had missed his boat when he came to Dunedin from Wellington for private reasons. He applied to the wharf controller for work and was told that if he joined up with the Home Guard he could x be employed. The accused had done so. He had served four years in the Seaforth Highlanders in the last war, and had served three years with the mercantile marine in the present war. Counsel submitted that the accused had failed through ignorance of his obligations to notify his change of address. —The accused was further remanded until Friday to enable him to be medically examined by the military authorities. Bail was allowed in the accused's own recognisance of £SO and one surety of £SO. Maintenance Order

Stuart Charles Watson was proceeded against by his wife on a complaint, for a maintenance order. —Mr C. J. L. White appeared for the complainant and Mr O. G. Stevens for the defendant. —After hearing evidence, the magistrate granted the application and fixed maintenance at 15s a week. Costs (£1 Is) were allowed.
