MAGISTRATE’S COURT
Tuesday October 15 (Before Mr J. R. Bartholomew.' S.M.) Undefended Cases Judgment by default was given for the plaintiffs in the following cases:Robert Walls v. Alexander M. Miller, claim £2 15s 6d, for goods supplied, with costs (£1 5 £ 6d); Albert E Glover v. B. O’Toole, claim £2 13s f 6d, for goods supplied, with costs (£lssGd); Ronald Ellis Brown v. J. Williams, claim £3 10s. for work done, with costs (£1 5s 6d). f Judgment Summons W. T. Beveridge, Ltd,, v. M. Fitzgerald. claim £4 16s 3d on a judgment summons.—The debtor did not appear, and an order was made fpr immediate payment pf the amount, with costs (8s), in default five days’ imprisonment. Fur Company Sued His Worship delivered his reserved judgment in the case in which Margaret Alison Barry, who was represented by Mr J. C. Mowat, proceeded against the New Zealand Fur Company. Ltd., claiming the sum of £45 3s, being the amount paid for a fur coat, together with the amount allowed for an old coat (£lo).—Mr J. C. Thomson represented the defendant. — After reviewing the evidence, the magistrate said that the sale was of a specific article on which certain work was required to be done. The stipulated work was not done, and the plaintiff was within her rights in objecting and in refusing to accept the coat in the condition in which it was delivered. Judgment for the plaintiff for the full amount would, therefore, be given, with costs (£7 8s) and solicitor’s fee (£4 3s), and the defendant would be allowed costs amounting to £1 9s for a change of venue of the hearing.
