Charge Dismissed Kathleen Chooquee, John Healey, and Victor Fanning Kett pleaded not guilty to having stolen three hens valued at 13s 6d, the property of Helena Sidey.—Mr C. J. L. White appeared for Chooquee and Kett. — Giving evidence in the case against Chooquee, Robert James Pratt, a gardener in the employ of Lady Sidey, said that on the afternoon of December 8 there were 14 white leghorn hens in the complainant’s fowl pen, which was locked. On the following morning, however, the screws had been removed from the latch and three of the fowls were missing.—Constable Wroblenski said that on the morning of December 9, at the request of the accused Chooauee, he went to a house rSnted by John Healey, and noticed that there was a disturbance in the bedroom. On entering, he found Chooquee there in company with three men. While passing through the kitchen, witness noticed what appeared to be cooked fowl and rice on a large plate, and on asking Healey what this was. the latter replied that he thought it was pork. Chooquee said that it was a cooked fowl which she had purchased from a poulterer in the city. Further investigation, however, disclosed a white feather on the floor, and in the oven, a plucked fowl which still had traces of white feathers adhering to it. When a subsequent visit was made to the house in company with Sergeant Stark, three pairs of fowls’ legs were found in a pot in the kitchen, as well as some partlyformed hens’ eggs. A sack with white feathers in it and some partially burned white feathers were also discovered. —To Mr White: His reason for going to the house was that Chooquee had complained that she had been assaulted by Kett.— Sergeant Stark gave .evidence that the accused had denied all knowledge of the missing fowls.—Mr White, at this stage, submitted that there was no suggestion of a case against Chooquee, and the magistrate. for lack of evidence, dismissed the charge.—ln view of this decision, the police withdrew the informations against the other two defendants.
