ADMISSION OF MISCONDUCT NOVEL DIVORCE POINT RAISED (Per United Press Association) AUCKLAND, Nov. 20. Whether a husband could properly bring an action for divorce on the ground of desertion _ when his wife had left him following ah admission of adultery was raised in the Supreme Court by Mr Justice Smith. , To prove desertion, said his Honor, it had to be shown that there had jbeen a breach of : matrimonial cohabitation against •.-the will of the petitioner for- a period of three years.-’ His Honor raised the point whether in the case before him there had not been separation by agreement, and the suit was not based on this. _ , The petitioner was Frank Bidgood, and the respondent Avis Mary Ruth Bidgood. The petitioner gave evidence that his wife, after an admission of misconduct, had packed up and left home. , . ... '■ His Honor reserved his decision.
