M'Arthur for special leave to appeal against the New South Wales Supreme Court's judgment dismissing his application for a writ of prohibition directed against the extradition order.. Mr W. L. Ham, K.C., contended, on behalf of the appellant, that the warrant issued in New Zealand under the Fugitive Offenders Act was invalid because the circumstances of its issue had not satisfied New Zealand law, and there was no sworn information by a person having a practical knowledge of the offence alleged against M'Arthur. A New Zealand detective, F. Robinson, had admitted in his depositions that he knew nothing about the circumstances. He had merely acted upon the instructions of his superior officers. Mr Ham. also claimed that the only legislative authority capable of conferring jurisdiction upon the magistrate to order the fugitive's return was the Commonwealth Parliament, which, up to the present, had made no law covering the particular circumstances of M'Arthur's case. The hearing is proceeding. ' PAINLESS DENTISTRY SYDNEY, February 25.
