STRUCK BY MOTOR CAR
WIDOWS CLAIM FAILS DUTY OF PEDESTRIANS (Per United Press Association) WELLINGTON, October 30. Mr Justice Reed nonsuited Margaret Kelso, a widow, in a claim for £1177 9s 6d from Eric Liverton, a sheep farmer, of Masterton, in respect to injuries received through being knocked down by a car. His Honor said that on her own evidence she was not in his view entitled to recover. She had stepped from the pavement and had not looked for a car she had seen further down the road. She had walked at an angle and had been struck on the left side of the road. His view of the duty of a pedestrian was that when leaving the footpath to cross the road he should keep his attention focussed upon the direction from which a vehicle might come until he had crossed the road. In the circumstances it was as much the duty of the pedestrian to keep a proper lookout as it was the duty of the motorist.
