ANTWERP FIRM’S CLAIM. An Antwerp forwarding agent closed with the New Zealand Shipping Company, which is a member of the New Zealand Cbnfcrence, a freight contract for the transport of 1700 tons of basic slag from Antwerp to Auckland by the s.s. Rangitata. This transport had to be effected on the conference conditions fixed In July, 1930. which stipulated. Inter alia, that the freight Antwerp-Auckland is 30s per ton, but that shippers undertaking to entrust to conference lines ail their shipments of phosphates and basic slag. Including shipments of associated, or subsidiary, firms in which Ihey are Interested, directly or indirectly, were entitled to a rebate of 10s per ton, payable at the time of settling the freight. The Antwerp agents of the steamship company claimed from the forwarding agent an undertaking signed by their principals, and the Belgian firm signed the undertaking. It was learned later that the 1700 tons had actually been sold c.i.f. Auckland by the London firm, of which Ihe Antwerp firm was only the Belgian agent, and the Antwerp forwarding agent, which, it declared, was not feasible. Thu steamship company thus refused to deliver the bill of lading, except against ’payment of the full freight of 30s. It was ultimately agreed to deliver the bill of lading against a bankers guarantee of £BSO (10s per ton), pending a legal decision.
